A toxic tort is a personal injury caused by exposure to dangerous substances or devices, such as:
- Agent Orange;
- Asbestos;
- Lead paint;
- Pesticides such as dioxin and DDT;
- Dry cleaning solvents and other chemicals;
- Cosmetics;
- Electromagnetic fields generated by utilities or major appliances; and
- Hazardous waste.
Individuals living near chemical manufacturing and disposal sites, employees who use chemicals in the work place and consumers who use chemical products in the household may be at risk of being toxic tort victims. The following are examples of injuries from toxic torts:
- Brain damage;
- Various forms of cancer;
- Respiratory diseases; and
- Birth defects.
Toxic tort victims may seek money damages for:
- Medical expenses;
- Lost wages;
- Emotional distress;
- Pain and suffering; and sometimes
- Punitive damages.
It may take years for the effects of toxic substance exposure to be discovered, and a plaintiff must prove he or she was exposed to a particular substance, energy or device, used or controlled by a person or business, which led to injuries and damages. If you believe you are a victim of a toxic tort, the lawyers at Overchuck & Byron are available to answer your questions.
